Why doesn’t the lawsuit challenge the legislation head on?
Because the organization behind it – the Second Amendment Foundation – does not believe that universal background checks are unconstitutional. It supports them.
SAF’s Alan Gottlieb loves him some universal preemptively-prove-your-innocence presumption of guilt. While he [sort of] opposed I-594, which imposes unconstitutional PPYI at the state level, that was only because he was pushing I-591, which supported national PPYI on every-frickin’-body. This should sound familiar, since he infamously bragged that he helped write the infamous Manchin-Toomey-Schumer-Gottlieb amendment meant to…
…impose national PPYI on every-frickin’-body.
Personally, I suspect that Gottlieb is taking on this anti-RKBA stance for the same reason that the NRA doesn’t actively fight most restrictive bills. The NRA makes a lot of money fundraising to “fight” gun control. Therefore, they – and Gottlieb – need existing gun control to rationalize more fundraising. Bowtie Boy just takes a little more direct action to create something to – most profitably – “fight.”

But Bowtie Bitch can prove my suspicions wrong. All he has to do is throw his, and SAF’s, full support into the effort to pass a WA bill to repeal I-594 in its entirety, including the Bitch’s beloved background checks (and backdoor registration).
Your call, Gottlieb. Make the announcement. But pardon me if I don’t hold my breath; hypoxia is bad for long term life expectancy.
